in the upcoming term. california's proposition 8 is not on that list. ktvu's brian flores is in san francisco to tell us what that means for same-sex marriage here in california. >> reporter: hi, dave, good morning. it appears for now that opponents of proposition 8 will have to wait until the end of the week for any decision on this from the u.s. supreme court. we were waiting to hear some decision. but it appears the supreme court will at least delay it until about friday, though. the key was whether the prop was gonna be on their cases. now, if that happens, that means the decision won't come until june. this postpones any decision until later this week. come friday morning, we'll be at this to see if the supreme court agrees with the lower court on whether gay marriage is unconstitutional or if they will keep prop 8 as voted on back in 2008. a lot of reac-- a lot of reaction from the castro district. we'll stay on this. back to you. >> thank you. now, our washington, d.c. newsroom is also following this. coming up at 7:15, we'll have more analysis of what this morning's developments could

prop 8 in california. if that is struck down, does that mean marriage equality then for all intents and purposes is legal in all states? does what happens in california then change the relevance for 49 other states? >> well, this all gets to how the supreme court rules. you know, i think it was the ninth circuit -- the ninth circuit court of appeals when they upheld the decision written by judge vaughn walker. judge vaughn walker didn't go for the big expansive constitutional right to marry that ted olson and david boies was hoping he would go for. he had a very narrow ruling. will the supreme court stick to that narrow ruling? if they do, same-sex marriage, assuming prop 8 is knocked down, then same-sex marriage could just be limited to california. and what we could end up have happening is a situation where you have something like 20% of the country where same-sex marriage is legal and if richard is right and doma is struck down as unconstitutional where you could have legally married same-sex couples in, say, california or new york who are then able to avail themselves of the 1,1
